We all sometimes think we need credit and desire to have the bigger and the better. For many out there, they get the credit and then something happens to which they can’t pay off their credit. Many get the credit knowing that they can’t pay it off. If they practice credit control, they can avoid the debt collection. However, many don’t. Many people out there have a stack of debt collection notices that they just do nothing with because they are in a jam. What do you need to know about debt collection?

Debt Collection Being Fair

How many of us have gotten the debt collectors calling non stop and things of that nature? Even though we owe money, we shouldn’t be harassed. That is why there is the debt collection law. You will be happy to know that one of those laws is that they can only call during day hours and they cannot call you while you are at work. They have no right to call your friends either.

The Process

So, how does this begin with the debt collection process? They first are assigned you from the lender. When they get this referral, they then are to notify you on paper. From there, they will call you. It is within the guidelines, that they cannot harass you as a means of calling your home though. This is the initial process of debt collecting. They should only collect the amount that is owed to the agency for which they are collecting and not more. They are there to also give you debt collecting advice. Some of you may not have the money still up front and they are there to work with you so all parties are happy.
 

During the Contact


When they call your home, they should tell you who they are and who they are with. They cannot threaten you. Rather, they act as a help to help you pay off your debt so that legal action will not be used. In most cases, they are easier to work with and can help you in ways that most lenders will not. Once it goes to debt collection they work with you until they get it in full plus they don’t tack on any interest. Even though you didn’t’ practice credit control, you are entitled to some rights too.

 

Most of the time they will set up a payment plan for you. You tell them what you can pay per month or per week and they submit this to the lender. What it all boils down to is that the lender just wants their money. They don’t want to harass you and they just don’t’ have the time to work with you. Make sure you are treated fairly. Once again, you deserve a fair chance to repay it and not the harassment that others have dealt with in the past. Don’t let people tell you any differently.
