The best part of being in business or a consumer of goods and services is the various types of credit available to use for purchases. There are even types of credit for people with bad credit. Often times when making purchases using your credit, you may discover the merchandise was faulty or damages consumers will it slide. However depending on the amount of the purchase may make some people rethink letting it go. Whether you decide to let the purchase go or don’t know what to do here are a few steps to help you recover on faulty goods and services when you use your credit:

Your Rights - You should know that you have the exact same rights paying by credit than you have when paying with cash. That means goods must be sold to match their description, serve the purpose it was intended and of average quality. In the case of services they have to be conducted under reasonable care and usage of skills, performed in a reasonable time frame at a reasonable cost.

Where to go in case of a problem - When you have complaints or disputes it’s best to contact the supplier first. Upon notification if the supplier refuse to resolve your problem or is no longer in business, your credit card company can legally waive your responsibility; however this depends upon your credit card agreement.
 

Know what purchases release liability

 - Most often if you buy goods or services under a for hire purchase or conditional sale or credit agreement the company who issued the credit (i.e. store or finance company) is responsible for any faults due to faulty goods or services. However if you purchase good and/or services using a major credit card, check or trade arrangement with the supplier under £100 values leaves the suppler liable any thing over this amount is the liable of both the creditor and the supplier. Consider these circumstances that must apply:

  • The credit issued must be that offered by the store or business where the goods or services were purchased.
  • The credit card agreement must should evidence it’s in compliance with the Consumer Fair Credit Act.
  • You have to be the card holder and purchaser of the goods to place a claim
  • In the case of joint card holders, you have to make a joint credit card claim or at least the account member who sign the credit card agreement.
  • You have to notify the credit issuing company should you have problems with a claim for faulty goods or services with the supplier or business.
  • If you obtain a bank loan to make the purchase and the item is faulty you are still liable to pay the bank or third party lender despite the condition of the product or services.
